GENERAL TERMS OF RENTAL

Compagnie Européenne des Loueurs de Skis manages bookings, hereafter referred to as the “Booking(s)”, on this website, hereafter referred to as the “Website”, by internet users visiting the Website, hereafter referred to as the “Customer(s)”, for the rental of winter sports equipment, hereafter referred to as the “Rental” from shops that are members of the Compagnie Européenne des Loueurs de Skis network, hereafter referred to as the “Rental Shop(s)” of which the list is shown on the Website.

Compagnie Européenne des Loueurs de Skis is one of the brand names of the company GO SPORT France, French Société par Actions Simplifiée (simplified joint-stock company) with share capital of 36 000 000 Euros, whose registered office is located at 17, avenue de la Falaise, 38360 Sassenage (France) and whose unique identification number is 428 560 031 at the Trade and Companies Registry in Grenoble, France.

These General Terms of Rental (hereafter “GTR”) are entered into between Compagnie Européenne des Loueurs de Skis and any Customer making a Booking via the Website. 

These GTR define the terms and conditions of booking and renting winter sports equipment on the Website, and are binding on the Rental Shop which also complies with them.  

The confirmation by the Customer of a Booking on the Website implies the latter’s full and unreserved acceptance of these GTR. The GTR may be amended as decided exclusively by Compagnie Européenne des Loueurs de Skis. The conditions applicable to a Booking are those in force on the Website on the date of placing the corresponding Booking. 

 

ARTICLE 1: EQUIPMENT AND SERVICES

The winter sports equipment offered for Booking on the Website is described on the latter, being specified that only categories of equipment are offered; no precise model is indicated. 

The general characteristics of each of the categories offered are shown on the Website, along with several examples of equipment corresponding to each of the categories. The Customer therefore selects and books a category of equipment. The examples of equipment are given as an indication only.

Compagnie Européenne des Loueurs de Skis undertakes, on behalf of the Rental Shops, to provide equipment that is equivalent in technical aspects and quality to that of the category booked.

The various equipment is available, subject to confirmation by Compagnie Européenne des Loueurs de Skis. This confirmation is sent by email to the address provided by the Customer.

ARTICLE 2: BOOKING

A Booking on the Website may be made at the latest on the day before the date of the start of the rental period requested.

2.1- In order to make the Booking, the Customer performs the following operations on the Website.

  1. Choice of a ski resort.
  2. Indication of a rental period of 1 to 14 days maximum by selecting the first and last day of rental: the Customer may adjust the Rental period using the “multi-date” personalisation system.
  3. Selection of the Rental Shop open in the resort and selection of the period indicated previously.
  4. Selection of the equipment required by adding the categories of equipment chosen to the booking (hereafter “Equipment Booked” or the “Equipment”).
  5. Selection of the services of the said shop by adding the services chosen, where applicable, to the booking.
  6. Identification to book on line and finalise the order.
  7. Selection of the type of payment (total or partial), means of payment (bank card or cheque) then consultation of the General Terms of Rental.
  8. After acceptance of the GTR, payment.

2.2 - Payment by bank card or cheque

In the case of payment by bank card, the online booking may be made, depending on the Rental Shop, up to 24 hours prior to the date of the start of the Rental.

In the case of payment by cheque, it must be made payable to GO SPORT France. This method of payment is no longer available if the start of the Rental begins less than 7 clear days after the Booking.

Only the actual cashing of the cheque or, in the case of payment by bank card, the receipt by Compagnie Européenne des Loueurs de Skis of the agreement from Mercanet BNP, which controls the payments by bank card, makes the Booking effective.

Upon receipt of the cheque or agreement from Mercanet BNP, a confirmation email of the Booking is sent to the Customer, with confirmation of the details of the Equipment Booked, the Rental period and the price, and the name and details of the Rental Shop. This confirmation should be printed and presented by the Customer to the Rental Shop on the first day of the Rental period.

It is specified that, in the event that the cheque, for any reason, may not be cashed by Compagnie Européenne des Loueurs de Skis, the Booking will no longer apply and an email will be sent immediately in this respect to the Customer.

In the event of rejection of the payment by bank card, the Customer is informed of this when paying on the Website. Compagnie Européenne des Loueurs de Skis reserves the right to simply cancel the Booking previously recorded.

ARTICLE 3: PRICE OF THE RENTAL

3.1 - Price

The rental price of the Equipment is defined according to the category of Equipment Booked, the place of booking (of the Rental Shop) and the Rental period chosen according to the prices in force for the period selected on the date of the Booking.

The final price to pay is indicated as a Tax-inclusive price in Euros; the administrative costs and any options and guarantee payments are included in this tax-inclusive price.

The rental price of the Equipment is lower than or equal to the reference price displayed in the Rental Shop in question, (the reference price being understood as the public price excluding any special offer or discount). The discount on the rental price of the Equipment granted on the Website to the Customer may be up to 60% of the shop reference price depending on the shop and the period selected on the date of the Booking. No discount is applicable on the “Eco Pack”, Multiglisse option and administrative costs.

The offer granted on this Website may not be used with any other special offer. Any promotional code used may not be used with another promotional code, in any form whatsoever.

Any rental made directly in a Rental Shop that has not been involved in a Booking on the Website will be made at the price of the said Rental Shop.

3.2 – Payment

In order for the booking to be accepted, the Customer should make a full or partial payment of the price upon the Booking.

The full payment corresponds to the payment of the following elements:

  • Rental of the Equipment as stipulated in article 3.1 above.
  • Special offer to be deducted where applicable or to replace the price stipulated in article 3.1 above.
  • Additional discount related where applicable to the use of the Feelgood Loyalty Card on the Website.
  • The “theft breakage” ski and/or “holiday cancellation” insurance where applicable.
  • The “Multiglisse” option where applicable
  • The administrative costs of an amount of €1 including tax per pack rented; these costs may not exceed a total amount of €5 including tax for one order.

The partial payment covers:

  • The amount of the deposit representing 30% of the rental price of the Equipment;
  • The “theft breakage” ski guarantee.
  • The administrative costs indicated above.
  • The “Multiglisse” option where applicable.

The partial or full payment is made:

  • Either by bank card using a secure transmission system (only bank cards with the CB, Visa, Mastercard, Carte Bleue, e-Carte Bleue symbols, issued in France or as part of the international networks approved by GIE cartes bancaires, are accepted),
  • Or by cheque if the Booking takes place more than 7 clear days prior to the start of the Rental

Transactions are made in Euros.

3.3 – Payment of the remainder of the price further to a partial payment

In the event of a partial payment, the remainder of the Rental price for the Booking will be paid by the Customer directly to the Rental Shop, when collecting the Equipment.

ARTICLE 4: COLLECTION OF EQUIPMENT BOOKED

The Customer collects the Equipment Booked in the Rental Shop with which the Booking has been made and confirmed in the Booking email.

The Rental Shop provides the Customer with the Equipment Booked upon presentation of the Booking confirmation email.

The Equipment Booked may be collected the day before the first day of rental, as from the time indicated by the Rental Shop on the Website (generally 5.00 p.m.) and subject to availability.

The Rental Shop provides the Customer with a rental form indicating:

  • the Equipment Booked, 
  • the date of collection of the said equipment and
  • the planned date for returning the Equipment Booked. 

This form is signed by the Customer as from taking possession of the Equipment.

ID may be requested from the Customer when collecting the Equipment Booked.

A security deposit may also be requested by the Rental Shop for a maximum amount equal to the public tax-inclusive sales price of the Equipment Rented. The security deposit may be in the form of a cheque, a credit card imprint or a payment pre-approval. It will be returned in full to the Customer upon returning the Equipment Booked, except in the cases stipulated in article 9 below.

Any delay in collecting the Equipment Booked should be notified to the Rental Shop.

After a period expiring at 10.00 a.m. on the day after the date of the start of the Rental, the Rental Shop will be free to consider the Booking as lapsed and to offer the Equipment Booked to other Customers. Compagnie Européenne des Loueurs de Skis will in any event keep the deposit paid by the Customer or the equivalent of 30% of the payment if it was made in full.

Where a Customer would like to collect the Equipment Booked late due to a situation of force majeure, which the Customer should prove, the Rental Shop will endeavour to meet with the Customer’s request. It is however specified that the Rental Shop may not be held liable for any absence of availability of the Equipment Booked (force majeure situation refers to any unforeseeable and unavoidable event beyond control, as defined by case-law).

In this last case and if the Customer has made a full payment, Compagnie Européenne des Loueurs de Skis will refund the difference between the number of days booked by the Customer and the number of days actually used by the Customer further to the latter’s delay, within 30 days, by:

  • Crediting the bank card used for the transaction;
  • Cheque if the Customer paid by cheque.

ARTICLE 5: AVAILABILITY OF THE EQUIPMENT

The Equipment Booked will be available for the period chosen by the Customer in the Rental Shop. The rental will therefore automatically come to an end on the dates and at the times indicated on the rental form.

Compagnie Européenne des Loueurs de Skis may not be held liable for any error or delay in the availability by the Rental Shop in question; only the latter is responsible for this.

The Rental Shops may not be held liable for the delays in availability of the rented Equipment, for reasons beyond their control or a situation of force majeure. In such an event, the Rental Shop will endeavour, depending on the stocks available in the shop, to provide the Customer with equipment of equal or superior quality to that booked, without any additional price.

Any claim regarding the Equipment Booked should be sent directly to the Rental Shop, by registered letter with confirmation of receipt.

ARTICLE 6: AMENDMENT OF A BOOKING

The Customer may not amend his/her booking directly on the Website.

Only our customer service department is authorised to make amendments as requested by the Customer and sent by email to resa@gosportmontagne.com specifying:

  • in the subject header of the email “Amendment of a booking”,
  • in the main body of the email, the booking number and the type of amendment.

It is specified that Compagnie Européenne des Loueurs de Skis will only agree to amend a Booking in the following limited situations:

  • Amendment of the rental period within the Rental Shop.
  • Addition or removal of equipment and services within the Rental Shop
  • Change of shop over the same rental period.

Subject to the following conditions:

  • If the Customer amends his/her booking and if the Rental costs are higher, the difference will be invoiced to the latter at the price in force of the Rental Shop. Compagnie Européenne des Loueurs de Skis keeps the amount initially paid. The additional amount will be included in the remaining amount to be paid in the shop.
  • If the amount of the booking amended is lower than the price initially invoiced: 
      • Where the customer has paid 100% of his/her online booking, the difference will be paid to the bank account used for the payment within a maximum period of 30 days.
      • Where the customer has only paid the deposit on line, the difference will be deducted from the balance to be paid in the shop.
  • If the Customer alters his/her booking less than 48 hours prior to the start of the Rental, this amendment will be deemed as a cancellation of the previous booking, in accordance with the conditions described in article 7 below.

No amendment of the Booking may be accepted after 48 hours before the date of the start of the Rental.

Thus, if the Customer reduces the rental period or does not collect all of the Equipment on his/her Booking, for any reason whatsoever, the payment of the deposit and the payment of the final balance of the rental price may not give rise to a refund.

ARTICLE 7: CANCELLATION OF A BOOKING

7.1 - Withdrawal

The Customer has a right to withdrawal; he/she may withdraw from the Rental of the Equipment Booked as long as he/she does so within a period of 14 calendar days as from receipt of the Booking confirmation email, by sending his/her withdrawal request:

  • either by letter to the following address: GO SPORT France, service Montagne, 17 avenue de la Falaise, 38360 Sassenage, France.
  • or by email to the following address: resa@gosportmontagne.com 

 

Compagnie Européenne des Loueurs de Skis will return the amount paid upon the booking by payment to the bank account used for the booking within a maximum period of 30 days following the withdrawal request.

However, in accordance with article L. 121-28° of the French Consumer Code, the Customer may not use his/her right to withdrawal once he/she has had access to the rental and/or to any other service before the end of the period of fourteen clear days.

After this period of 14 days, the Customer may cancel a booking in the following conditions:

7.2 – Cancellation before collection of the Equipment Booked

Bookings may not be cancelled on the Website.

Only the customer service department of Compagnie Européenne des Loueurs de Skis is entitled to make cancellations at the request of the Customer sent by email 48 hours before the date of the start of the rental, to resa@gosportmontagne.com specifying:

  • in the subject header of the email “Cancellation of a booking”,
  • in the main body of the email, the booking number and the reason for the cancellation.

The cancellation is governed in accordance with the conditions set forth in the following table:

However, where the cancellation takes place further to a force majeure situation (force majeure situation being any unforeseeable and unavoidable event beyond control) experienced by the Customer, that the latter should prove, Compagnie Européenne des Loueurs de Skis will keep the administrative costs and refund the remainder of the amount paid by the Customer within a maximum period of 30 days.

When a cancelled booking is refunded to the Customer, the refund will be made by:

  • Crediting the bank card used for the transaction.
  • Cheque if this method of payment was used by the Customer for the transaction.

7.3 – Cancellation after collection of the equipment

After collection of the equipment, as the Customer will have taken the Equipment from the shop, the cancellation is no longer possible. The Customer may not claim any refund of any amounts incurred upon the booking.

ARTICLE 8: TERM OF THE RENTAL

The term of the Rental corresponds to the period indicated on the Booking, shown on the Rental Form.

A Rental day begins at 9.00 a.m. and ends at 6.00 p.m.

This term may not be amended in any event without consent from the Rental Shop.

ARTICLE 9: USE OF THE EQUIPMENT AND RESPONSIBILITY

Any adjustment of the Equipment Booked is made exclusively by the Rental Shop.

The Customer bears full responsibility for the Equipment Booked as soon as he/she takes possession of it. He/she remains liable for it until its full return.

The rented Equipment is meant for the sole use by the persons indicated in the Booking as using the said equipment, without any possibility of sub-letting, or even a loan without payment. The Customer is deemed as the only person able to assess the capacity of the persons using the rented equipment. 

He/she certifies that these persons are able to use the Equipment rented and undertakes on his/her own behalf and on that of the persons indicated in the Booking as using the rented equipment that these persons use the said equipment themselves, according to the instructions for use, with care, and without causing danger to others. The Customer is free to choose the category of Equipment booked and rented and will remain solely liable for any unsuitability of the equipment rented for the specific purposes of the persons indicated in the Booking as using the said equipment and for all adjustments other than those made by the Rental Shop.

The Equipment Booked is deemed to be in a good condition and fit for a normal use. It must be returned as such.

Any reservation on the state of the Equipment Booked must be notified to the Rental Shop upon collection of the Equipment; an indication will be added to the rental form.

Where no reservation is made in accordance with the terms above, no claim will be accepted subsequently.

Upon expiry of the term of the rental stipulated on the rental form, in the event of lack of return on the date and at the times indicated, the Customer will remain solely liable for the Equipment in his/her possession until its actual return.

The Equipment Booked is returned at the end of the day of the period indicated in the rental form or the following day before 10.00 a.m. Any delay in return after 10.00 a.m. the following day will give rise to invoicing by the Rental Shop of a day’s rental per day late, at the price indicated in the Rental Shop.

The lack of return may give rise to the implementation of a return procedure, the costs of which will be borne by the Customer, in addition to the Equipment not returned, invoiced at its tax-inclusive market value on the intended date of return, the rental costs and any damages.

The Customer remains liable for any damage caused to the Equipment Booked, with the exception of normal wear and tear or hidden defects. He/she incurs his/her liability for any other damage, which will give rise to the payment of repair costs or even costs for the replacement of the said Equipment, within the maximum limit of the as-new replacement value of the equipment, in addition to the rental price. The Customer undertakes to pay these costs upon return of the Equipment Booked, where appropriate by offsetting against the security deposit stipulated in article 4 of these GTR. Any repair is made exclusively by the Rental Shop.

ARTICLE 10: "Breakage / Theft" Guarantee:

10.1: Guarantee period

At the time of the ORDER the RENTER has the opportunity to subscribe to the guarantee proposed by CELS.

This guarantee covers:

Any damage that might occur to the ARTICLE(S) ordered and reserved, whether:
o Partial, i.e. which requires professional action to make the ARTICLE fit for use;
o Total, i.e. the ARTICLE has become unfit for use and cannot be repaired for less than the price of a new ARTICLE.
Any theft of a part or all of one of the ARTICLE(S);
With regards to cases of theft, the original declaration established by the police station or gendarmerie must be transmitted to CELS within forty-eight hours (48 h) following the declaration.

10.2: Declaration of an accident

The RENTER must notify the CELS shop within twenty-four hours of finding out. The RENTER agrees to establish a statement of breakage or theft with the CELS shop

10.3: Guarantee Limits

The following are excluded from the CELS guarantee:

• Cases of loss, forgetting, substitution of the ARTICLES;
• Cases of damages resulting from non-confirming use of the ARTICLE(S) rented;
• Cases of damages resulting from voluntary acts by the RENTER or persons for whom they are responsible.
In these cases, the RENTER shall be required to reimburse the total value of the ARTICLES. This amount should be entirely paid to the company managing the shop where the ARTICLE(S) was (were) collected.

10.3.1 Costs

ARTICLE 11: MULTIGLISSE OPTION

When selecting the fee-paying “Multiglisse” option (optional): the Customer will have the possibility, depending on the availabilities of the Rental Shop, to exchange the Equipment or equipment booked for any other available equipment in the same category, as long as the rental price of the Equipment is identical or the Customer pays the additional price. If the Customer does not choose the “Multiglisse” option, any change in equipment will be invoiced directly to the customer by the Rental Shop.

In the event of an exchange for equipment of a lower price, the difference will not be refunded. In the event of an exchange for equipment of a higher price, the customer must pay the additional price. The exchange of equipment provided by the “Multiglisse” option is only possible twice during the same holiday.

 

ARTICLE 12: INTELLECTUAL PROPERTY

The whole Website and each of its elements fall under the legislation on intellectual property, in particular copyright, drawings and models, trademarks, domain names, software or databases… (without this list being complete).

In this respect, all reproduction, representation and public communication rights are reserved as the property of Compagnie Européenne des Loueurs de Skis including for the downloadable documents and the visual, photographic, audio-visual or other representations.

Only the right to consult the Website is granted to the Customers. The reproduction of all or part of the content is only authorised for the exclusive purpose of information for a personal and private use.

Any link set up towards the Website must be previously authorised in writing by Compagnie Européenne des Loueurs de Skis. Compagnie Européenne des Loueurs de Skis declines any liability regarding the content of these links.

In any event, the hypertext links directing to the Website should be removed upon first request from the Company.

 

ARTICLE 13: PERSONAL DATA

The information requested by Compagnie Européenne des Loueurs de Skis is necessary for processing the order.

The customer has a right to access, amend, rectify, delete data about him/her, by writing to Compagnie Européenne des Loueurs de Skis:

ARTICLE 14: SEVERABILITY OF CLAUSES

The nullity, unlawfulness or inapplicability of any clause whatsoever of these General Terms of Rental may not entail the nullity, unlawfulness or inapplicability of the other clauses of these GTR.

ARTICLE 15: APPLICABLE LAW

These GTR are subject to French laws. Any dispute related to their interpretation and/or their performance will be referred to the civil courts with territorial jurisdiction.
